SOPPA and What It Means for Choosing a Provider

The Student Online Personal Protection Act took effect on July 1, 2021 and reshaped how Illinois districts manage vendor relationships. Under 105 ILCS 85, districts carry obligations that reach directly into technology procurement.

 

  • Written agreements with K-12 service providers that collect student data

  • Annual public posting of the operators of online services the district uses

  • Annual public posting of the data elements collected, how they are used, and to whom they are disclosed

  • Breach notification, with public posting within 10 days and parent notification within 30 days

  • A designated privacy officer and a documented policy governing who may sign operator contracts

  • Reasonable security procedures, with the same requirement written into vendor agreements

 

Districts must also refresh the posted information twice a year, by January 30 and within 30 days of the start of each fiscal year. For a district without dedicated compliance staff, that becomes a recurring administrative task rather than a one-time project.

 

QNS works within that framework rather than around it. District legal counsel remains the authority on compliance questions. Our role is to make sure the technology side does not create problems for the people responsible for answering them.
